9. International Data Transfers

Your information may be processed and stored in countries other than your country of residence. We ensure appropriate safeguards are in place for international transfers.

For users in the European Union, transfers outside the EU are governed by the EU General Data Protection Regulation (GDPR) and are protected through Standard Contractual Clauses (SCCs) or other legally recognised transfer mechanisms.

For users in Switzerland, transfers outside Switzerland are governed by the Swiss Federal Act on Data Protection (nFADP) and are protected through Standard Contractual Clauses (SCCs) as recognised by the Swiss Federal Data Protection and Information Commissioner (FDPIC).

For users in India, transfers outside India are governed by the Digital Personal Data Protection Act (DPDPA 2023). We ensure that any third party receiving your data outside India provides an adequate level of protection through contractual agreements or other appropriate safeguards, in accordance with applicable Indian law.

For users in other countries, we apply appropriate technical and organisational measures to ensure your data receives a level of protection consistent with applicable local laws.

• Onboarding emails to help you get started (activating location, completing your profile, adding items…)

• Engagement emails to inform you of relevant activity (items from other users, potential matches…)

• Feedback requests about your experience

• Legal and policy notices, including updates to our Terms & Conditions, Privacy Policy, or Cookie Policy.

Legal basis: We process your email address for this purpose on the basis of our legitimate interest in operating and improving our service, supporting your onboarding experience, and keeping you informed of relevant activity and legal updates.

For users in the European Union, this is based on Article 6(1)(f) of the GDPR.

For users in Switzerland, this is based on our overriding interest under the Swiss Federal Act on Data Protection (nFADP).

For users in India, we process your email address based on your consent under the Digital Personal Data Protection Act (DPDPA 2023).

For users in other countries, we process your email address based on your consent or as otherwise permitted by applicable local law.

Your rights: You can opt out of receiving onboarding, engagement, and feedback emails at any time by clicking the Unsubscribe link in any email, or by contacting us at [email protected]. Opting out will not affect your access to the app, or the receipt of mandatory legal notices.

We will not use your email address for promotional or marketing purposes without your explicit consent.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of significant changes via:

• In-app notifications
• Email (if you've provided one)
• Updated policy posted in the app

13. Data Breach Notification

In the event of a personal data breach, we will notify affected users and relevant supervisory authorities in accordance with applicable law:

EU users: We will notify the relevant EU supervisory authority within 72 hours of becoming aware of a breach, in accordance with GDPR Article 33. Where the breach is likely to result in a high risk to your rights and freedoms, we will also notify you directly without undue delay.

Swiss users: We will notify the Federal Data Protection and Information Commissioner (FDPIC) as soon as possible after becoming aware of a breach that is likely to result in a high risk to you, in accordance with nFADP Article 24.

Indian users: We will notify the Data Protection Board of India (DPBI) as soon as possible after becoming aware of a breach, in accordance with DPDPA 2023.

US users: We will notify affected US users and relevant state authorities as required by applicable state law. For California residents, we will provide notice in accordance with the California Consumer Privacy Act (CCPA/CPRA) without unreasonable delay.

All users: We will inform you of the nature of the breach, what data was affected, likely consequences, and measures we are taking to address it.
